{"id":842,"date":"2023-06-08T16:55:42","date_gmt":"2023-06-08T15:55:42","guid":{"rendered":"https:\/\/heddi-avocat.fr\/?p=842"},"modified":"2025-03-01T16:15:04","modified_gmt":"2025-03-01T15:15:04","slug":"taverny-illegalite-partielle-dun-ensemble-immobilier","status":"publish","type":"post","link":"https:\/\/heddi-avocat.fr\/?p=842","title":{"rendered":"Taverny: ill\u00e9galit\u00e9 partielle d&rsquo;un ensemble immobilier"},"content":{"rendered":"\n<p style=\"font-size:17px\">Par un jugement du 6 juin 2023, le tribunal administratif de Cergy-Pontoise a jug\u00e9 ill\u00e9gal le permis de construire d&rsquo;un projet d&rsquo;ensemble immobilier sur le territoire de Taverny (Val d&rsquo;Oise).<br><br>Le tribunal a retenu que le projet ne permettait pas d&rsquo;assurer la conservation d&rsquo;un s\u00e9quoia prot\u00e9g\u00e9 par le PLU au titre de de l&rsquo;article L. 311-1 du code de l&rsquo;urbanisme (arbre isol\u00e9 class\u00e9). En effet, bien que le projet ne pr\u00e9voyait pas l&rsquo;abattage du s\u00e9quoia, la proximit\u00e9 de certaines constructions projet\u00e9es (b\u00e2timent en surface \u00e0 4 m\u00e8tres du tronc et parking souterrain au pied de l&rsquo;arbre) \u00e9tait de nature \u00e0 porter atteinte au syst\u00e8me racinaire de l&rsquo;arbre et, par cons\u00e9quent, \u00e0 compromettre la conservation de celui-ci.<br><br>Le p\u00e9titionnaire dispose d&rsquo;un d\u00e9lai de six mois pour r\u00e9gulariser le projet.<br><br>Les requ\u00e9rants ont \u00e9t\u00e9 conseill\u00e9s et repr\u00e9sent\u00e9s devant le tribunal par Pierre HEDDI.<\/p>\n\n\n\n<div class=\"wp-block-file\"><a id=\"wp-block-file--media-cc51af66-ee1c-40b6-98ed-a00f65199387\" href=\"https:\/\/heddi-avocat.fr\/wp-content\/uploads\/2023\/06\/1126485545_2109198_06062023.pdf\">TA Cergy-Pontoise, 6 juin 2023, n\u00b0 2109198<\/a><\/div>\n","protected":false},"excerpt":{"rendered":"<p>&#8230;<\/p>\n","protected":false},"author":1,"featured_media":0,"comment_status":"closed","ping_status":"open","sticky":false,"template":"","format":"standard","meta":{"_kadence_starter_templates_imported_post":false,"_kad_post_transparent":"","_kad_post_title":"","_kad_post_layout":"","_kad_post_sidebar_id":"","_kad_post_content_style":"","_kad_post_vertical_padding":"","_kad_post_feature":"","_kad_post_feature_position":"","_kad_post_header":false,"_kad_post_footer":false,"footnotes":""},"categories":[5],"tags":[28,18,22],"class_list":["post-842","post","type-post","status-publish","format-standard","hentry","category-actualites-du-cabinet","tag-arbres","tag-permis-de-construire","tag-urbanisation"],"yoast_head":"<!-- This site is optimized with the Yoast SEO plugin v24.5 -
