{"id":848,"date":"2023-07-19T17:33:08","date_gmt":"2023-07-19T16:33:08","guid":{"rendered":"https:\/\/heddi-avocat.fr\/?p=848"},"modified":"2025-06-19T18:07:45","modified_gmt":"2025-06-19T17:07:45","slug":"illegalite-de-la-dup-des-travaux-de-la-gare-de-bondy-grand-paris-express","status":"publish","type":"post","link":"https:\/\/heddi-avocat.fr\/?p=848","title":{"rendered":"Ill\u00e9galit\u00e9 de la DUP des travaux de la gare de Bondy (Grand Paris Express)"},"content":{"rendered":"\n<p style=\"font-size:17px\">Par un jugement du 18 juillet 2023, le tribunal administratif de Montreuil a jug\u00e9 ill\u00e9gale la d\u00e9claration d&rsquo;utilit\u00e9 publique (DUP) de la ligne 15 Est du Grand Paris Express pour ce qui concerne les travaux de la future gare de Bondy. <br><br>Le tribunal a relev\u00e9 plusieurs irr\u00e9gularit\u00e9s dans l&rsquo;\u00e9tude d&rsquo;impact du projet : le caract\u00e8re erron\u00e9 du plan de circulation des poids-lourds ; l&rsquo;absence d&rsquo;analyse de l&rsquo;incidence de la centrale \u00e0 b\u00e9ton et de la circulation des poids-lourds sur la qualit\u00e9 de l&rsquo;air ; l&rsquo;insuffisance des mesures de protection d&rsquo;un secteur sensible (cr\u00e8che) contre les nuisances sonores r\u00e9sultant du chantier.<br><br>Le tribunal a sursis \u00e0 statuer sur le recours et a accord\u00e9 un d\u00e9lai de 12 mois au ma\u00eetre d&rsquo;ouvrage pour r\u00e9gulariser la DUP. <br><br>La requ\u00e9rante \u00e9tait conseill\u00e9e et repr\u00e9sent\u00e9e par Pierre HEDDI.<\/p>\n\n\n\n<div class=\"wp-block-file\" style=\"margin-top:0;margin-bottom:0\"><a id=\"wp-block-file--media-d60089de-1fcd-404d-8cbb-442a6b1122a8\" href=\"https:\/\/heddi-avocat.fr\/wp-content\/uploads\/2023\/07\/TA-Montreuil-18-juillet-2023-n\u00b0-2214218.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">TA Montreuil, 18 juillet 2023, n\u00b0 2214218<\/a><\/div>\n\n\n\n<p><\/p>\n\n\n\n<p style=\"font-size:17px\"><strong><span style=\"text-decoration: underline;\">Mise \u00e0 jour<\/span><\/strong>: par un jugement du 19 juin 2025, le tribunal administratif de Montreuil a consid\u00e9r\u00e9 que, malgr\u00e9 l&rsquo;actualisation de l&rsquo;\u00e9tude d&rsquo;impact, la DUP de la ligne 15 Est n&rsquo;avait pas \u00e9t\u00e9 r\u00e9gularis\u00e9e en ce qui concerne les itin\u00e9raires des poids-lourds. En outre, compte tenu de l&rsquo;\u00e9volution du projet, l&rsquo;expropriation de la parcelle de la requ\u00e9rante n&rsquo;\u00e9tait pas n\u00e9cessaire.
